Terms of Service

These Terms of Service ("Terms") govern your access to and use of beytrax.com (the "Site"), operated by Beytrax ("Beytrax", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms cover the marketing Site only. Provision of paid services — multi-tenant CMS, custom website design and development, managed hosting, and SSL / domain care — is governed by a separate written agreement (the "Master Services Agreement" or "MSA") signed between Beytrax and the client. Where these Terms conflict with an MSA you have with us, the MSA controls for the services it covers.

1. Eligibility

The Site is intended for business audiences. You represent that you are at least the age of majority in your jurisdiction and have the authority to enter into these Terms (and, if acting on behalf of a company, to bind that company).

2. Use of the Site

The Site is provided for informational purposes. You may:

  • Browse and read public content.
  • Contact us using the channels we provide.
  • Share links to public pages provided you attribute them to Beytrax.

You may not:

  • Copy, scrape, reproduce, or republish substantial portions of the Site without prior written permission.
  • Use the Site to send unsolicited communications, malware, or content that infringes others' rights.
  • Attempt to access non-public areas, probe for vulnerabilities, bypass authentication, or interfere with availability (DDoS, automated scraping at abusive rates, etc.).
  • Use the Site or our services to violate applicable law (including export controls, sanctions, privacy, and anti-fraud laws).
  • Misrepresent your affiliation with Beytrax, our clients, or any other person or organisation.

Responsible-disclosure reports about vulnerabilities are welcome at security@beytrax.com. Please do not exploit a finding or access data that is not yours.

3. Intellectual property

The Site, including its text, layout, design, code, graphics, the "Beytrax" name, the chevron and wordmark, and the selection and arrangement of content, is owned by Beytrax or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your own informational and evaluation purposes only. All other rights are reserved.

Trademarks, logos, and brand names of our clients displayed on the clients page or elsewhere are the property of their respective owners and are used with their permission.

4. Third-party services and links

The Site may link to third-party websites or services (Stripe, hosting partners, social media, our clients' sites, etc.). We do not control and are not responsible for the content, policies, or practices of any third-party service. Your use of those services is governed by their own terms and privacy policies.

5. Forms and submissions

When you submit a contact form, request a quote, or otherwise send us information, you confirm the information is accurate and that you have the right to share it. We handle submissions in accordance with our Privacy Policy.

6. Paid engagements (MSA)

Specific commercial terms — scope, deliverables, support windows, service-level agreements, fees, payment terms, confidentiality, intellectual-property assignment, warranties, indemnities, and term and termination — are set in a separate Master Services Agreement (or in a Statement of Work referencing the MSA) signed between Beytrax and the client. Use of the Site does not by itself create a service relationship.

7. Availability and changes

We may modify, suspend, or discontinue any part of the Site at any time, with or without notice. We may also update, revise, or remove content at our discretion. We are not liable for any modification, suspension, or discontinuation of the Site. (Availability of contracted services is governed by the MSA, not by these Terms.)

8. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free. Information on the Site is for general information only and does not constitute legal, financial, tax, or other professional advice.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYTRAX, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Liability arising from paid services is governed by, and capped under, the applicable MSA.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud or wilful misconduct).

10. Indemnification

You agree to defend, indemnify, and hold harmless Beytrax and its affiliates from and against any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right.

11. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or are using the Site abusively. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

12. Governing law

These Terms are governed by the laws of Mexico, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be submitted to the exclusive jurisdiction of the competent courts in Mexico City, Mexico, except that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property. Disputes arising from paid services are governed by the dispute-resolution clause of the applicable MSA.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Continued use of the Site after a change indicates acceptance of the revised Terms.
